Who gets to say no
A Tarrant County judge stopped Westlake acting on its data center agreement, county officials asked the House for siting authority, and ERCOT told lawmakers the audit finishes in late November or early December.
Westlake's council took up its data center development agreement on August 17 and tabled it unanimously. The town says a Tarrant County judge has temporarily restrained it from acting on the agreement. A hearing is set for August 26 at 10:00 AM. The order does not prohibit a data center on the site. What is blocked is the town's own ability to act, and the development agreement is where the binding terms would have been written.
Everything else this week was a claim on a veto nobody has yet had to use. County officials asked the House State Affairs Committee on August 19 for a larger role in siting and regulation. MultiState counted more than 100 local ordinances and moratoriums considered by Texas municipalities since July 2025. The same committee debated moving large loads from 4CP to 12CP cost allocation, and a senior member said he intends to file legislation repealing the data center sales tax exemption. There is no bill text.
The state's own veto now has a date on it: ERCOT told the committee the audit Abbott ordered on August 3 will wrap "in late November or early December". Six more operators committed to the standards anyway. The standards are voluntary; the audit is not, and it has not reported.
Building did not stop. Texas Critical Data Centers secured construction permits in Ector County, AZIO launched Atlas One in South Texas, and Rowan Digital filed for the Lasso Building, its sixth and last in Temple. Each answers to a different gatekeeper — a permit office, a private gas plant, a city council that has not voted yet — and none waited on the audit.
A court stopped Westlake, and it is the week's only exercised veto.
Counties asked the House for siting authority, and industry said no.
